The company HAIRKONCEPT  which is the owner of the site  https://nicolas-t.be,undertakes to ensure that the processing of personal data carried out on the site  https://nicolas-t.be comply with the General Data Protection Regulation(GDPR)in force and the law of 30 July 2018  on the protection of natural persons with regard to the processing of personal data.

ARTICLE 1 – MANAGEMENT OF PERSONAL DATA

The Customer is informed of the regulations concerning the General Data Protection Regulation(GDPR: No. 2016-679)of the European Parliament and of the Council of 27 April 2016 (entered into force on 25 May 2018) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) as well as the Law of 30 July 2018  on the protection of natural persons with regard to the processing of personal data.

1.1 Responsible for the collection of personal data

For the Personal Data collected as part of the creation of the User’s personal account and his navigation on the Site, the person responsible for the processing of Personal Data is: HAIRKONCEPT  is represented by Nicolas POCHET its legal representative.

As the controller of the data it collects, HAIRKONCEPT  undertakes to comply with the framework of the legal provisions in force. In particular, it is up to the Customer to establish the purposes of its data processing, to provide its prospects and customers, from the collection of their consents, with complete information on the processing of their personal data and to maintain a register of processing in accordance with reality. Whenever  HAIRKONCEPT  processes Personal Data,  HAIRKONCEPT  takes all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which  HAIRKONCEPT  processes them.

1.2 Purpose of the data collected

HAIRKONCEPT may process all or part of the data:

• To allow navigation on the Site and the management and traceability of the services and services ordered by the user: connection and use data of the Site, invoicing, order history, etc.;
• To prevent and fight against computer fraud (spamming, hacking…): computer equipment used for browsing, IP address, password (hash);
• To improve navigation on the Site: connection and usage data;
• To conduct optional satisfaction surveys on https://nicolas-t.be: email address;
• To conduct communication campaigns (sms, email): phone number, email address.

HAIRKONCEPT does not market your personal data which are therefore only used out of necessity or for statistical and analytical purposes.

1.3 Right of access, rectification and opposition

• Right of access (Article 15 GDPR) and rectification (Article 16 RGPD), updating, completeness of Users’ data right to lock or delete Users’ personal data (Article 17 of the GDPR), when they are inaccurate, incomplete, equivocal, outdated, or whose collection, use, communication or storage is prohibited;
• Right to withdraw consent at any time (Article 13-2c GDPR);
• Right to limit the processing of Users’ data (Article 18 GDPR);
• Right to object to the processing of Users’ data (Article 21 GDPR);
• Right to the portability of the data that users have provided, when these data are subject to automated processing based on their consent or on a contract (Article 20 GDPR);
• Right to define the fate of users’ data after their death and to choose to whom HAIRKONCEPT must communicate (or not) its data to a third party that they have previously designated.

As soon as HAIRKONCEPT  is aware of the death of a User and in the absence of instructions from him,  HAIRKONCEPT  undertakes to destroy his data, unless their storage is necessary for probationary purposes or to meet a legal obligation.

If the User wishes to know how HAIRKONCEPT  uses his Personal Data, request to rectify them or oppose their processing, the User may contact  HAIRKONCEPT by email at the following address:  tgpd@nicolas-t.be.

In this case, the User must indicate the Personal Data that he would like HAIRKONCEPT  to correct, update or delete, by identifying himself precisely with a copy of an identity document (identity card or passport).

Requests for the deletion of Personal Data will be subject to the obligations imposed on HAIRKONCEPT by law, in particular with regard to the storage or archiving of documents. Finally, users of  https://nicolas-t.be may lodge a complaint with the supervisory authorities, and in particular with the OPC (Commission for the Protection of Privacy)(https://www.privacycommission.be/).

1.4 Non-communication of personal data

HAIRKONCEPT is prohibited from processing, hosting or transferring the Information collected on its Customers to a country located outside the European Union or recognized as “not adequate” by the European Commission without first informing the customer. However,  HAIRKONCEPT  remains free to choose its technical and commercial subcontractors on the condition that they present sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: No. 2016-679).

HAIRKONCEPT undertakes to take all necessary precautions to preserve the security of the Information and in particular that it is not communicated to unauthorized persons. However, if an incident affecting the integrity or confidentiality of the Customer’s Information is brought to the attention of  HAIRKONCEPT,it must as soon as possible inform the Customer and communicate the corrective measures taken. In addition,  HAIRKONCEPT does not collect any “sensitive data”.

The User’s Personal Data may be processed by HAIRKONCEPT subsidiaries and subcontractors (service providers), exclusively in order to achieve the purposes of this policy.

Within the limits of their respective attributions and for the purposes mentioned above, the main persons likely to have access to the data of HAIRKONCEPT Users are mainly the agents of our customer service.

1.5 Types of data collected

HAIRKONCEPT also collects information that improves the user experience and offers contextualized advice.

This data is kept for a maximum period of 12 months after the end of the contractual relationship.

ARTICLE 2 – INCIDENT NOTIFICATION

No matter how hard you use, no method of transmission over the Internet and no method of electronic storage is completely secure. As a result, we cannot guarantee absolute security. If we become aware of a security breach, we will notify the affected users so that they can take appropriate action. Our incident notification procedures take into account our legal obligations, whether at national or European level. We are committed to fully informing our customers of all matters related to the security of their account and to providing them with all necessary information to help them comply with their own regulatory reporting obligations.

No personal information of the user of the site https://nicolas-t.be is published without the knowledge of the user, exchanged, transferred, assigned or sold on any support to third parties. Only the assumption of redemption of  HAIRKONCEPT  and its rights would allow the transmission of such information to the prospective purchaser who would in turn be given the same obligation to store and modify data with respect to the user of the site  https://nicolas-t.be.

2.1 Security

To ensure the security and confidentiality of Personal Data, HAIRKONCEPT  uses networks protected by standard devices such as firewalls, pseudonymization, encryption and password.

When processing Personal Data, HAIRKONCEPT  takes all reasonable measures to protect it against loss, misuse, unauthorized access, disclosure, alteration or destruction.

ARTICLE 3 – HYPERTEXT LINKS “COOKIES” AND INTERNET TAGS

The site https://nicolas-t.be  contains a number of hypertext links to other sites, set up with the permission of  HAIRKONCEPT. However,  HAIRKONCEPT  does not have the possibility to check the content of the sites thus visited, and therefore assumes no responsibility for this fact.

3.1 « Cookies »

HAIRKONCEPT may process the User’s information about his visit to the Site, such as the pages consulted, the searches carried out. This information allows  HAIRKONCEPT to improve the content of the Site, the navigation of the User.

If necessary, HAIRKONCEPT  declines all responsibility for the consequences related to the degraded operation of the Site and the services possibly offered by  HAIRKONCEPT,resulting from(i) the refusal of Cookies by the User (ii) the impossibility for  HAIRKONCEPT to record or consult the Cookies necessary for their operation due to the choice of the User. For the management of Cookies and the User’s choices, the configuration of each browser is different. It is described in the help menu of the browser, which will allow you to know how the User can modify his wishes regarding Cookies.

At any time, the User may choose to express and modify his wishes regarding Cookies. HAIRKONCEPT  may also use the services of external service providers to help it collect and process the information described in this section.

Finally, by clicking on the icons dedicated to social networks appearing on the site https://nicolas-t.be or in its mobile application and if the User has accepted the deposit of cookies by continuing his navigation on the Website or the mobile application of  HAIRKONCEPT,the social networks appearing on the Site may also deposit cookies on your terminals (computer, tablet, mobile phone).

3.2 Internet tags

HAIRKONCEPT may occasionally use Internet beacons (also known as “tags”, or action tags, one-pixel GIFs, transparent GIFs, clear GIFs and one-by-one GIFs) and deploy them through a web analytics partner that may be located (and therefore store the corresponding information, including the User’s IP address) in a foreign country.

These tags are placed both in online advertisements allowing internet users to access the Site, and on the various pages of it.

This technology allows HAIRKONCEPT to evaluate the responses of visitors to the Site and the effectiveness of its actions (for example, the number of times a page is opened and the information consulted), as well as the use of this Site by the User.

The external service provider may collect information on visitors to the Site and other websites through these tags, compile reports on the activity of the Site for the attention of HAIRKONCEPT,and provide other services relating to the use of it and the Internet.
